By using Maki Services (“Maki,” “we,” “our,” or “us”), you agree to the following terms and conditions. Please read them carefully before accessing or using our platform.
1. Definitions
“Customer” – a user who books services through the platform.
“Service Provider” – a registered individual or business offering services through the platform.
“Affiliate” – a registered user promoting the platform and earning commissions from successful referrals.
“Wallet” – the digital wallet feature inside Maki used for commission, disbursement, and top-ups.
2. General Use
You must provide accurate and updated information when registering.
You agree not to use Maki for unlawful, fraudulent, or abusive purposes.
Accounts are non-transferable. You are responsible for maintaining the confidentiality of your login credentials.
3. Booking and Service Requests
Customers are responsible for providing complete and accurate booking details.
Service Providers must deliver services professionally and within agreed terms.
Maki is a facilitator only and is not a party to contracts between Customers and Service Providers.
4. Payments, Wallet, and Disbursements
Customers may pay through integrated Payment Gateways or via the Maki Wallet.
Service Providers must maintain sufficient wallet balance to cover Maki’s commission before receiving bookings.
By joining the platform, Service Providers authorize Maki to collect payments on their behalf.
Service Provider earnings are disbursed upon request, subject to processing times and fees.
Refunds to Customers are subject to Maki’s Refund Policy.
Any request for a refund will be verified by Maki prior to approval.
Only upon confirmation of validity will the corresponding refund amount be deducted from the Service Provider’s balance.
5. Affiliate Program
Affiliates earn commissions for successful referrals and transactions.
Commissions are subject to review, validation, and approval by Maki.
Fraudulent or abusive activities will result in termination of affiliate status and forfeiture of earnings.
6. Commission and Fees
Maki charges Service Providers a commission per successful booking.
The commission rate may vary by service category and is deducted automatically from the Service Provider’s wallet.
Fees are non-refundable unless required by law.
7. No Employment Relationship
Nothing in this agreement creates an employer-employee relationship between Maki and Service Providers, Customers, or Affiliates.
Service Providers are independent contractors responsible for their own tools, permits, taxes, and compliance with laws.
8. Content and Intellectual Property
Service Providers may upload profiles, service descriptions, and media. You warrant that all uploaded content is accurate and lawful.
Maki retains ownership of the platform’s design, software, and brand assets.
Users grant Maki a non-exclusive license to display content for marketing and operational purposes.
9. Privacy and Data Protection
Personal data is processed in accordance with the Philippine Data Privacy Act (RA 10173).
Users consent to the collection and use of their data for service provision, payment processing, and platform improvements.
10. Limitations of Liability
Maki shall not be liable for:
The quality, safety, legality, or outcome of services provided by Service Providers.
Any indirect, incidental, or consequential damages.
Delays or disruptions due to force majeure events (natural disasters, technical failures, etc.).
11. Termination and Suspension
Maki reserves the right to suspend or terminate accounts that violate these Terms.
Users may terminate their accounts by written request, subject to settlement of all obligations.
12. Dispute Resolution
Disputes between Customers and Service Providers should first be resolved amicably between parties.
Maki may mediate at its discretion but is not obligated to arbitrate disputes.
Legal disputes shall be governed by the laws of the Philippines, with exclusive venue in Muntinlupa City courts.
13. Changes to Terms
Maki may update these Terms from time to time.
Continued use of the platform after updates constitutes acceptance of the new Terms.
